General Terms and Conditions (GTC) of mucad GmbH

1. Scope

1.1 These General Terms and Conditions (GTC) apply to all business relationships between mucad GmbH (hereinafter referred to as “we” or “us”) and our customers (hereinafter referred to as “Customer”), who purchase spare parts and consumables for cutting plotters from us.

1.2 Deviating or supplementary terms and conditions of the Customer shall only become part of the contract if we have expressly acknowledged them in writing.

1.3 These GTC shall also apply to future business relationships, even if they are not explicitly referred to again.



2. Conclusion of Contract

2.1 The presentation of spare parts and consumables on our website does not constitute a binding offer but merely an invitation to submit an offer.

2.2 The contract is concluded when we accept the Customer’s offer either by sending an order confirmation via email or by delivering the goods.

2.3 The order confirmation includes details of the ordered items, their prices, and estimated delivery times.



3. Prices and Payment Terms

3.1 All prices are stated in euros and are exclusive of statutory VAT (where applicable).

3.2 Unless otherwise agreed, payment is due within 14 days from the invoice date.

3.3 In the event of non-payment within the specified period, we reserve the right to charge default interest at a rate of 9.2% above the base interest rate. Additionally, we may withhold delivery or withdraw from the contract.

3.4 Our prices are non-binding and subject to change at any time. The applicable price is the one valid at the time the Customer’s order is received by us.



4. Delivery and Shipping

4.1 Delivery is made to the shipping address provided by the Customer.

4.2 Delivery typically takes [x] working days unless otherwise agreed.

4.3 We are entitled to make partial deliveries, provided this is reasonable for the Customer. Additional shipping costs will only be charged if expressly agreed.

4.4 The risk of accidental loss or deterioration of the goods passes to the Customer upon handover to the Customer or a person designated by them.



5. Right of Withdrawal

5.1 Customers who are consumers within the meaning of the Austrian Consumer Protection Act (KSchG) have the right to withdraw from the contract within 14 days without giving any reason.

5.2 The withdrawal period begins on the day the Customer receives the goods.

5.3 To exercise the right of withdrawal, the Customer must inform us (mucad GmbH, Gschwend 414A, 6932 Langen bei Bregenz, Austria) of their decision to withdraw from the contract by means of a clear declaration (e.g., a letter sent by post or an email).

5.4 In the event of withdrawal, we are obliged to refund all payments received from the Customer, including delivery costs (except for additional costs resulting from the Customer choosing a delivery method other than the least expensive standard delivery offered by us), without delay and no later than 14 days from the day we receive notice of the withdrawal. The refund will be made using the same payment method used by the Customer in the original transaction unless expressly agreed otherwise.

5.5 The Customer bears the direct cost of returning the goods.



6. Retention of Title

6.1 The goods remain our property until full payment has been received.

6.2 The Customer is obliged to treat the goods with care while the retention of title is in effect and must promptly inform us of any defects or damage.



7. Warranty and Liability

7.1 The statutory warranty rights under the Austrian Civil Code (ABGB) apply to delivered spare parts and consumables.

7.2 For used goods, a warranty period of [6 months] applies, unless otherwise agreed.

7.3 We do not accept liability for damages resulting from improper use or tampering with the products by the Customer.

7.4 We are only liable for indirect damages, consequential damages, or lost profits in cases of intent or gross negligence.



8. Data Protection

8.1 We collect and process personal data strictly in accordance with applicable data protection laws, especially the General Data Protection Regulation (GDPR).

9. Final Provisions

9.1 Amendments and additions to these GTC must be made in writing.

9.2 If any provision of these GTC is or becomes invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to the intended economic purpose.

9.3 Austrian law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

9.4 The exclusive place of jurisdiction for all disputes arising from this contract is Feldkirch (Regional Court of Feldkirch).
